Promotion: “Who is Our Mystery Celebrity?” Sweepstakes (the ”Sweepstakes”) is sponsored by BareWeb, Inc. (“Sponsor”). The Sweepstakes starts at 5:00 PM Eastern Time (“ET”) on February 13th, 2017 and ends at 1:00 PM ET on February 16th, 2017 (“Sweepstakes Entry Period”). All applicable federal, state and local rules apply. Void where prohibited.
Who may enter: Sweepstakes open only to legal residents of the 50 United States or District of Columbia who are 18 years of age or older as of time of entry who have an Instagram account. Employees, officers, and directors of Sponsor and any and all other companies associated with this Sweepstakes (“Sweepstakes Entities”), and members of their immediate families (spouse, parents, siblings and children) or households are not eligible to participate. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
How to enter: During the Sweepstakes Entry Period, you can enter by telling us “Who is our mystery Celebrity?” in the comment section of the Sweepstakes post via Instagram. You must use the hashtag below. You can enter the Sweepstakes in the following way:
- To enter via Instagram, go to the Bare Necessities Instagram Page https://www.instagram.com/barenecessities and follow us. In the comments, tell us “Who is our mystery celebrity?”. Add this hashtag to your entry “#bnsweepstakes”. Private accounts must be made Public to be entered.
Only one (1) Instagram entry per day. A Week starts at 12:01 AM ET Monday and ends at 11:59 PM ET each Sunday of the Sweepstakes Entry Period. The same content cannot be entered more than once.
Please note: You must be a member of Instagram to enter. To become a member of Instagram, go to www.Instagram.com to request a free membership. Instagram membership or access is not controlled by and cannot be guaranteed by Sponsor. (The person entering is referred to as an “Entrant”). In the event of any dispute regarding any entry, Sponsor reserves the right to disqualify that entry or entrant from the sweepstakes. Receipt of entries will not be acknowledged or returned. Entries will not be judged. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. All Entries and requests become Sponsor’s property and will not be returned or acknowledged.
Requirements of Entries: Your entry must comply with the following and by entering you represent and warrant and agree that:
- The content must comply with the terms and conditions of Instagram.
- The content does not contain any third party copyrighted material, products, trademarks or logos, other than those owned by sponsor (with the exception of incidental use as determined in the sole discretion of the sponsor).
- The content does not defame or otherwise violate the rights of any third party.
- The content cannot be offensive or contain any elements such as nudity, graphically violent imagery, sexually suggestive imagery, or be explicitly racial, profane, slanderous, or visually depict alcohol or gambling or be contrary to the interests of Sweepstakes or Sponsor, as determined in the sole discretion of the Sponsor.
- The content has not been previously published or submitted in any other promotion.
Licensed Rights: Entrants retain ownership of the content submitted in this Sweepstakes however, by entering you grant Sponsor and any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes, the perpetual, fully-paid, irrevocable, non-exclusive license to reproduce, prepare derivate works of, distribute, display, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use and perform throughout the world the entry in any manner, form, or format now or hereinafter created, including on the internet, and for any purpose, including, but not limited to, advertising or promotion of Sponsor and the Sweepstakes, all without further consent from or payment to you or any Third Party Participants, Identifiable Persons or any other entity or individual (“License”). The entry may be published and posted online but you agree that Sponsor has no obligation to post or publish your entry, that all such postings or publication, if any, will be in Sponsor’s sole discretion and that the posting or publication of an entry, including user likes, has no bearing on whether that entry will be selected as a winner. You will hold harmless Sponsor, its officers, directors, employees, divisions, affiliates, subsidiaries, advertising and promotional agencies, from any claim by any third party relating to any rights in the entries you submit.
Selection of Winner: There will be one (1) winner, which will be selected from among all eligible entries received during the Sweepstakes Entry Period. The odds of winning a prize depends on the number of entries received during each day of the Sweepstakes Entry Period.
Winner Notification: The potential winners will be notified through commenting on the Instagram entry. If a potential prize winner does not respond to the winner notification (sent twice) within 72 hours or if an email is undeliverable or if an entrant is otherwise found to be ineligible, or if the selected winner cannot accept or receive the prize for any reason, the potential prize winner will forfeit the applicable prize and a new winner will be selected at random. The Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any. Entry and acceptance of prize constitutes permission (except where prohibited by law) to use each winner’s name, prize won, hometown and likeness for promotional purposes without further compensation. Limit: one prize per person/email/household.
Prizes: 1 One (1) prize winner will receive a signed book plus a piece of lingerie from the mystery celebrity not to exceed $100 (One Hundred Dollar). They will also receive a complimentary over-the-phone bra fitting from one of our amBRAssadors™. Total AVR of all prizes to be awarded is no more than $125. Winners are responsible for all local, state and federal taxes and fees, if any. No substitution or cash alternative permitted, except in the sole discretion of the Sponsor.
Conditions: Entrants agree to these Official Rules and the decisions of the Sponsor, and on their behalf, and on behalf of their respective heirs, executors, administrators, legal representatives, and their successors and assigns (“Releasing Parties”), release, defend and hold harmless the Sweepstakes Entities, Instagram Inc., as well as the employees, officers, directors and agents of each (“Released Parties”), from any and all actions, causes of action, suits, losses, indirect or direct damages, consequential, incidental, punitive or exemplary damages, judgments, claims and demands whatsoever, in law, or equity, whether known or unknown, foreseen or unforeseen, against Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from Entrant’s participation, acceptance and use or misuse of any prize. Sponsor is not responsible for any typographical or other error in the printing of the offer or in the announcement of any prize or in the event Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any force majeure event beyond its control, or any federal, state, or local government law, order, or regulation, or order of any court, or other like causes. Entrants assume all liability for any injury, including death or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any prize. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes, or (iv) the failure of any third party to comply with the instructions and proper administration of this Sweepstakes. Sponsor reserves the right to permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and terminate the Sweepstakes if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes). In the event of termination, Sponsor in its sole discretion may award the remaining Prizes from among all eligible Entries received prior to termination. All prizes will be awarded provided a sufficient number of eligible Entries are received. Any attempt by a participant to exceed or manipulate the entry limitations, including by using multiple/different email addresses or any other methods, will void that entrant’s entries and that entrant may be disqualified. Use of script, macro or any other automated system to enter is prohibited. Any and all legal actions or claims arising in connection with the Sweepstakes must be brought in a court of competent jurisdiction within the United States and the terms, or any dispute, will be governed by the laws of the state of New Jersey, without giving effect to any choice of law or conflict of law rules, which could cause the application of the laws of any jurisdiction other than the State of New Jersey. Any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THE SWEEPSTAKES. BY PARTICIPATING, ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. Sponsor’s failure to enforce any term of these rules shall not constitute a waiver of that provision.
Winner’s list: To receive a winners list after February 16th 2017, mail a self-addressed, stamped envelope to Bare Necessities, Attn: “Who is our mystery celebrity?”, 90 Northfield Avenue, Edison, NJ 08837. Requests must be received by April 20th, 2017.
Privacy: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy found at https://www.barenecessities.com/privacy.aspx. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of entrant’s personal information in accordance with the Sponsor’s privacy policy (which includes promotional e-mails from which entrants can opt-out of at any time) and acknowledges that entrant has read and accepted Sponsor’s privacy policy.
This Sweepstakes is not sponsored, endorsed or administered by Instagram, nor is Instagram associated with the Sweepstakes in any way.
